“SAFARICOM IS COMING HOME!” — KALONZO MUSYOKA HAILS COURT RULING

Wiper leader Kalonzo Musyoka has welcomed the High Court decision nullifying the Government’s sale of its 15 per cent stake in Safaricom PLC to Vodacom, describing the ruling as a victory for Kenyans and the protection of national assets.

“The People Have Won. Safaricom Is Coming Home,” Kalonzo said following the ruling.

A three-judge High Court bench declared the transaction unconstitutional, invalid, null and void and ordered that the 15 per cent stake be restored to the Government of Kenya on behalf of the people. The court cited, among other issues, inadequate meaningful public participation and the concealment or misrepresentation of material information concerning the transaction.

Kalonzo said the court decision vindicates efforts to challenge what he described as the unconstitutional disposal of one of Kenya’s most valuable national assets.

“It has been a privilege to walk through this journey and represent Kenyans in court against the unconstitutional sale of one of our most valuable national assets.”»

He further framed the ruling as extending beyond the Safaricom transaction, arguing that it reinforces constitutional principles surrounding the protection of public assets, transparency and accountability.

“This is not merely a legal victory. It is a declaration that Kenya’s sovereignty is not for sale,” Kalonzo said.

The ruling, however, has opened a new legal battle. Treasury Cabinet Secretary John Mbadi has confirmed that the Government will appeal the High Court decision, while Vodacom has also indicated that it intends to challenge the ruling and seek a stay pending the appeal.

The dispute over the 15 per cent Safaricom stake is therefore expected to move to the appellate courts, leaving the final legal position subject to further judicial determination.
