Lawyer’s Death Sparks National Outrage: LSK Demands Answers Over Alleged Police Brutality

The (LSK), through its President , expresses profound grief and deep concern following the tragic death of Mr. Tom Ouya Imbukwa, an Advocate of the High Court of Kenya, who succumbed to injuries sustained during a reported brutal assault.

This devastating incident marks a dark and painful moment for the legal profession and the nation at large. The Society extends its heartfelt condolences to Mr. Imbukwa’s family, friends, and colleagues during this time of immense loss and mourning.

Reports indicate that Counsel Imbukwa was discovered at Harambee SACCO Estate after being violently assaulted. He was initially found alive but in critical condition and was rushed to the Intensive Care Unit (ICU) at , where he later passed away despite medical efforts to save his life.

The circumstances surrounding this tragic incident raise grave concerns that demand urgent, transparent, and independent investigations. It is alleged that for approximately two weeks prior to the attack, Counsel Imbukwa had been living in fear after receiving threats from a police officer—forcing him to avoid his workplace and court duties. Additionally, before his condition worsened, he reportedly indicated that he had been assaulted by police officers alongside other individuals. These claims remain subject to verification through formal investigations.

Preliminary observations further suggest that Counsel sustained severe injuries reportedly consistent with torture, including disturbing allegations of the gouging of his left eye. Notably, while he was found with visible bleeding, officers at Savannah Police Post indicated there was no blood at the scene where he was discovered. This discrepancy raises serious questions as to whether the assault occurred elsewhere and whether there may have been attempts to conceal or distort critical evidence.

The LSK calls upon the , the (IPOA), and all relevant investigative agencies to act swiftly, impartially, and decisively to establish the truth and ensure that all those responsible are brought to justice.

The Society further reiterates its unwavering commitment to defending the rule of law, protecting the legal profession, and ensuring accountability for any violations of human rights. No advocate should live in fear for their life while discharging their constitutional duty.

The LSK will continue to closely monitor the progress of investigations and stands ready to support all efforts aimed at securing justice for the late Counsel Imbukwa.
